Terms of Use

Important: Presentempo is a presentation aid, not a safety-critical alarm. Device settings, operating-system limits, connectivity, battery, and hardware can affect cues. Test your chosen channels in Preflight and keep an alternative for critical deadlines.

1. Provider and scope

These terms govern use of the Presentempo app by Patrick Wagner, Darkstone, Uttendorf 13, 3385 Prinzersdorf, Austria. The terms of the store from which you obtain the app or make a purchase also apply. Mandatory consumer rights take precedence over conflicting provisions.

2. Licence to use

You receive a personal, non-exclusive, non-transferable, and revocable right to use Presentempo on supported devices under these terms and the applicable store rules.

3. Your content and files

You remain responsible for talk titles, sections, notes, results, and exported files. Enter only content you may process lawfully and check the recipient and destination before exporting or sharing a file.

Externally stored exports, email attachments, and operating-system backups are outside Presentempo's control. Back up important data responsibly and delete external copies at their destination.

4. Timer, cues, and watch features

Presentempo calculates timing locally and may offer visual, haptic, audio, notification, Live Activity, Apple Watch, or Wear OS cues depending on the platform.

5. Presentempo Free and Presentempo Pro

The free timer remains usable without a purchase. Presentempo Pro is intended as an optional, non-consumable one-time purchase in the relevant Apple or Google store ecosystem.

6. Availability, changes, and updates

We aim to provide a reliable app but do not guarantee uninterrupted, error-free, or identical availability on every device. Operating systems, stores, watch platforms, and third-party interfaces can change.

Updates may fix defects, improve security, or adapt features to changed platform requirements. Material adverse changes to paid functionality will be made only within the limits permitted by law.

7. Statutory warranty and liability

Statutory warranty rights apply. To the extent permitted by law, no guarantee is made that a particular cue will be delivered under every device, connectivity, Focus, Silent Mode, or power-saving state.

We remain fully liable for intent and gross negligence, personal injury, and liability mandated by product-liability or consumer law. For slight negligence, where legally permitted, liability is limited to breach of essential contractual duties and typically foreseeable loss.

8. Privacy and deletion

The Privacy Policy explains local storage, watch sync, backups, exports, RevenueCat, stores, support, and deletion. “Delete all local data” removes app data on the current device and requests deletion from a reachable watch; store records, external files, backups, and a disconnected watch are not removed automatically.

9. Termination

You may stop using Presentempo at any time, delete local data, and uninstall the app. Existing store transactions and statutory retention duties are not cancelled automatically. Rights of use may be terminated for material abusive or unlawful use within applicable law and store rules.

10. Law, consumer rights, and contact

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only where it does not remove mandatory protection of the country of habitual residence. Statutory venues remain unaffected.

We have not submitted to an alternative dispute-resolution body and are not currently legally obliged to do so. Mandatory rights to complain, obtain refunds, or seek judicial relief remain unaffected.
